“Rape Cops” Kenneth Moreno And Franklin Mata Lose Appeal

Two disgraced NYPD cops who raped a woman repeatedly in her apartment and got away with it last year are going to jail on official misconduct charges, a state appeals court ruled Thursday.

In a decision that stunned the city, an incompetent jury that had several attorneys on it, found rape cop Kenneth Moreno innocent of charges that he raped a drunk woman in her East Village apartment in 2008 while his partner Franklin Mata snoozed on her couch.

But the same jury found the raping duo guilty of three counts of official misconduct for each time they returned to the petite fashion exec’s E. 13th St apartment. Moreno, the supervising officer, was sentenced to one year in prison in Aug. 2011 and Mata got 60 days.

Rape cop Kenneth Moreno had admitted to singing Bon Jovi songs to the inebriated woman, spooning her and counseling her on alcoholism, while his partner slept in the living room, during their repeated early morning visits to her East Village apartment.

Despite the ridiculous rape acquittal, the judges determined that the dirty cops lied to their supervisors with the hope of an easy sexual hook up.

“While the events that occurred in the apartment are in dispute,” the decision read, “the evidence establishes that each of the defendant’s intent was, at least, to socialize with the (woman) with the view toward sexual intercourse, or to assist his partner in doing so.”
